Consumer Rights Under the Electronic Fund Transfer Act — What You Should Know

The Electronic Fund Transfer Act (EFTA) is a federal consumer protection statute that governs electronic transactions involving personal bank accounts. It establishes certain rights for consumers who experience unauthorized transfers or errors in their accounts — and sets obligations that financial institutions must meet when investigating disputes. Here is an overview of what the law provides.

1. The Right to Report Qualifying Disputes

If you experience an unauthorized transfer or electronic error, you generally have the right to report it to your financial institution and have it reviewed. Banks generally must investigate qualifying consumer error claims reported under Regulation E.

2. The Right to a Reasonable Investigation

When you report a qualifying error, your bank is required to conduct a reasonable investigation consistent with Regulation E’s error-resolution procedures. The law establishes specific standards for how that investigation must be conducted.

3. Provisional Credit During Investigation

In many cases, your bank may be required to provisionally credit your account while the investigation is ongoing. This obligation applies in specific circumstances defined by Regulation E, and the timing and conditions for provisional credit depend on the nature of the dispute.

4. The Right to a Written Explanation

If your bank determines that no error occurred, they are generally required to send you a written explanation of their findings. You may also have the right to request the documents and records they relied on in reaching that determination.

5. Consumer Liability Limits

The EFTA limits how much of a loss you may be personally responsible for, depending on when you reported the problem:

•        If you report within 2 business days of learning about the unauthorized transfer: maximum liability generally is $50

•        If you report between 2 and 60 days after your statement was made available: maximum liability may increase to $500

•        Reporting deadlines and liability limitations depend on several factors, including when you learned of the issue and when account statements were made available

Prompt reporting is important. Reporting timelines and liability limitations are complex and can vary depending on the circumstances of each case.

6. The Right to Pursue Legal Action

If your bank violated the EFTA, you may have the right to bring a claim in federal court. Potential remedies include actual damages, statutory damages that may be available under federal law, and attorneys’ fees where authorized. New York consumers can pursue these claims in the Southern District of New York or the Eastern District of New York.
